Hoti: Kurti is not ready to form the CSM separately from the other points, that's why he seeks signatures on agreements

Kosovo Prime Minister Albin Kurti is not prepared to establish any kind of Community of Serb Municipalities separately from other points of the agreements reached last year in Brussels and Ohrid, which is why his idea is to merge all agreements already signed by both sides into one document, analyst Afrim Hoti says. When both sides sign such a document, he adds, Kurti will consider it binding.

"Then he could go to the EU, the US, or anywhere and say: yes, we have a signed agreement and we can move forward," Hoti notes.

However, Hoti explains that the Vienna Convention on Contract Law specifies procedures and rules on how international agreements can be reached, stating that according to its provisions, an agreement between countries can be reached without being signed.

"And that's what the European Union took into account after Serbian President Aleksandar Vucic didn't want to, and still refuses to, sign the agreement because he doesn't want to leave anything in writing. From the EU's perspective, the agreement is binding. And that's true, as stipulated by the Vienna Convention," Hoti says.

On the other hand, he points out, Kurti insists on the existence of a signed document to produce a legally binding document.

"Although both versions are applicable from a legal point of view. Kurti's idea comes from a practical aspect because Serbia has agreed on something for a long time but hasn't implemented it," Hoti believes.
