Arsic: We have submitted a request to the Constitutional Court for a review of the constitutionality of the CBK decision regarding the dinar
Lawyer Vasilije Arsic emphasized to Kosovo Online that today he, along with his colleagues, had submitted a request to the Constitutional Court for a review of the constitutionality and legality of Article 35 of the Central Bank of Kosovo Regulation on the prohibition of the use of the dinar in Kosovo's payment system.
"I believe that this Regulation is illegal and unconstitutional because the Central Bank does not have the authority to make such decisions since the currency in Kosovo is regulated by law in accordance with the Constitution. Kosovo has not yet enacted a law regulating the currency to be used, and there is still a UNMIK regulation in force since 1999 which regulates that the dinar is an acceptable currency functioning in the payment system with certain fees," Arsic said.
He emphasizes that Article 35 of the CBK Regulation has violated the fundamental human rights guaranteed by the Constitution to the Serbian community.
"Through this regulation, the right to life, dignity, and property has been violated. People who receive income from central Serbia cannot sustain their livelihoods because they lack the means to do so. They cannot exercise their right to property acquired through salaries and pensions. Therefore, we believe that basic human rights guaranteed by the Constitution have been violated, and we demand that the Constitutional Court annuls Article 35 of the mentioned Regulation. In the meantime, we have requested interim measures to allow the dinar as a means of payment in Kosovo until the Constitutional Court decides on the constitutionality of this regulation," Arsic said.
His colleague, lawyer Dragutin Nenezic, who is also one of the applicants, stated to our portal that they were now waiting for further steps from the court.
"Now we are awaiting the verdict. We expect the Constitutional Court to invalidate the Regulation, especially Article 35, which is problematic for the Serbs. We anticipate a response to our request for interim measures in the shortest possible time, but it will take more time for everything else. The proceedings will follow their procedural course, and it takes time for everything to enter the judicial process. They will call us for hearings and inform us about further steps. The Constitutional Court is the only competent authority for this," Nenezic said.
