Kryeziu: Constitutional Court did not deal with the 2013 CSM Agreement
Kosovo Government Spokesperson Perparim Kryeziu says that the Constitutional Court did not deal with the Agreement on the CSM from 2013, but with the one from 2015, Gazeta Express reports.
Kryeziu points out that the Constitutional Court judged the Agreement from 2015 to be in contradiction with the points of the Constitution that speak about Kosovo's multi-ethnicity.
"The agreement from 2015 was contested because it is not in accordance with Article 3 of the Constitution, which indicates the multi-ethnicity of Kosovo. According to the Constitution, there cannot be an entity based on ethnicity in a multi-ethnic society. That is the decision of the Constitutional Court," Kryeziu said.
Kryeziu stated for TV1 that the Constitution could not annul the Agreement from 2013 because it had not been subject to change.
"If the Constitutional Court annulled the Agreement, why should it go to the Assembly? The Constitutional Court only answers the questions that are asked, it does not answer the potential sub-questions that arise," Kryeziu emphasized.
The only reason the court said in its interpretation that the CSM should be formed based on the Agreement from 2013 is that it did not consider that agreement, and the second is that it cannot cancel it with its interpretation of the Agreement from 2015, he explained.
