Special Prosecution of Kosovo: No information that Judge Laban is a threat to national security

The spokesperson of the Special Prosecution of Kosovo, Arbnora Luta, stated that the prosecution has not received any report, information, or complaint from the Intelligence Agency, Kosovo Police, Ministry of Internal Affairs, or anyone else claiming that Constitutional Court Judge Radomir Laban may pose a threat to the national security of Kosovo, Koha reports.

“We inform you that, according to the records of the Special Prosecution, there has not been a single case registered concerning the person you asked about. The prosecution remains committed to the fight against crime, corruption, and the protection of the public interest, acting in accordance with the law and the principles of justice,” Luta said in her response to “Oath for Justice.”

President Vjosa Osmani and now Deputy Speaker of the Assembly Albulena Haxhiu have, in several statements, expressed suspicions that Judge Laban could represent a threat to the national security of Kosovo, Koha recalls.

On August 5, Osmani initially announced that she was withdrawing her request to the Constitutional Court regarding the constitutive session of the Assembly of Kosovo, citing as the reason the appointment of Serbian judge Radomir Laban as the reporting judge in that process.

“I withdrew the request submitted to the Constitutional Court on July 22. I did so as an immediate reaction to confirmed information that Radomir Laban had been appointed as the reporting judge, and against him our security institutions in the years 2018, 2021, and 2024 had submitted clear and official data on dangerous activities. According to that information, this judge represents a threat to the national security of Kosovo and participated in activities against the constitutional order,” Osmani said at a press conference.

Shortly after her, Haxhiu also leveled accusations against Judge Laban. At a press conference, she called for the initiation of proceedings to dismiss Constitutional Court Judge Radomir Laban, claiming that he had been involved in criminal activities and represented a “threat to the constitutional order of Kosovo.”

The Constitutional Court of Kosovo, in response to President Osmani, stated that the assignment of cases to reporting judges and review panels of the Constitutional Court is based on clear procedural rules, which the court will strictly adhere to. The institution also pointed out that Judge Laban has been employed there since 2011 as a legal advisor, and since August 9, 2018, has served as a judge, after passing all constitutional and legal procedures on the proposal of the Assembly of Kosovo and by decree of the President of Kosovo.
