Baraliu: Administrative instruction unnecessary; how did Kurti participate in the April elections without it?

After Prime Minister Albin Kurti's statement that the most appropriate way to call for early elections in four municipalities in the north is a petition, the Professor of Constitutional Law in Pristina, Mazllum Baraliu, told Gazeta Blic that the petition was one of the models that gave the opportunity to participate in the elections, as well as that administrative instruction, was unnecessary and asked Kurti - how he had participated in the elections in April without such an instruction.

Baraliu explained that the petition was one of the models that gave the possibility to participate in the elections.

"An administrative instruction and a petition are the same things. A request or petition is one of the models that gives the possibility of participating in the elections, but several steps or procedures need to be carried out," Baraliu said.

As he stated, the first request had to be submitted by 20 percent of the electorate, and then, it should be sent to the President of the Municipal Assembly, who sent it to the CEC, which resolved the issue of voting.

That is why he believes that administrative instruction is "completely unnecessary".

"A question must be asked to the Prime Minister and the Government - how they managed without this administrative instruction in April, how they participated in the elections, at the local or central level, regular or extraordinary, without this?" With this provision, which is in force, as it was then, in Article 72 of the Law on Local Self-Government," Baraliu said.

It seems to him, he says, that the Government and the Ministry of Administration and Local Self-Government do not have sufficient coordination on this issue.
