Cakolli: Debates on punitive measures against MPs without legal basis

Eugen Cakolli, an associate of the Democratic Institute of Kosovo, stated that there is neither a constitutional nor procedural basis to revoke the mandates of members of the Kosovo Assembly in the event that the Assembly is not constituted within the 30-day period set by the Constitutional Court. According to him, debates about punitive measures against MPs have no legal foundation.
Cakolli told Kosova Press that the failure to elect the Speaker of the Assembly does not constitute grounds for losing a mandate.
"The Constitution specifies the circumstances under which an MP loses their mandate. These include resignation, death, failure to take the oath, a final conviction, effective prison sentence, and others. Nowhere in the Constitution does it say that failure to constitute the Assembly results in loss of mandate. That is not logical at all, and responsibility cannot be collective. The Constitutional Court cannot make such a decision," Cakolli said.
