Hasani on the appointment of Rasic: The Constitution of Kosovo has been violated
The former President of the Constitutional Court of Kosovo, Enver Hasani, said that the decision to appoint Nenad Rasic to the position of Minister for Communities and Returns had violated the Constitution of Kosovo.
Hasani stated for Kosovo Online that this procedure had violated Article 96 point 5 of the Constitution of Kosovo, which was explicit and stated that any re-appointment of a new minister from a community that was not in the majority in Kosovo required consultation with the political forces representing that minority community.
"This is nevertheless about a man who is not a member of the Kosovo parliament at all. The constitution clearly states that, when it comes to a minister who is not a member of the parliament, the majority of MPs of that minority community, i.e. 50 percent plus 1, must express their opinion on the issue." Hasani said.
Hasani is sure that the Constitutional Court will overturn the decision on the appointment of Nenad Rasic as Minister for Communities and Returns.
"I don't want to believe that the Constitutional Court will support such a decision," Hasani concluded.
