Hasani: I do not exclude the possibility that the Assembly will not be constituted within 30 days

Former President of the Constitutional Court of Kosovo Enver Hasani stated that he does not exclude the possibility that the Assembly of Kosovo will not be constituted within 30 days and that the Constitutional Court may once again intervene in line with the prescribed constitutional and legal procedure.

In an interview with Radio Free Europe, Hasani noted that the most recent decision of the Constitutional Court regarding the constitution of the Assembly is clear, but added that, given the behavior of the Self-Determination Movement, the thirty-day deadline will likely not be respected.

“If we assess Albin Kurti’s behavior, the situation is moving toward the non-constitution of the Assembly of Kosovo. He is applying the latest decision of the Constitutional Court with the aim of preventing the constitution of the Assembly of Kosovo. The Constitutional Court cannot be blamed for ambiguities. Both this decision and the one from June are clear. The problem has arisen, and always arises, in the political arena. It was the same in the past. The constitutional provisions were and remain clear, drawing a distinction between the constitution of the Assembly of Kosovo and the work of the Assembly of Kosovo after its constitution, as a constituent, legislative, supervisory, deliberative body and representative of the people of Kosovo,” he pointed out.

Hasani assessed that the only shortcoming of the Constitutional Court’s decision is that it does not specify a constitutional sanction.

As a possible sanction, he mentioned the disqualification of Avni Dehari, the chair of the constitutive session, or that, when cases of violation of the Constitutional Court’s decisions are identified, those responsible should be removed from leadership positions, in this case in the process of constitution.
