Hasani: Osmani’s withdrawal of the request is a violation of the Constitution — I believe the Court will not succumb to blackmail

Former President of the Constitutional Court of Kosovo, Enver Hasani, stated that the withdrawal of the request submitted by Kosovo President Vjosa Osmani to the Constitutional Court on July 22 is contrary to the Constitution and represents a flagrant violation of it, Kosova Press reports.

According to Hasani, the purpose of the withdrawal is to block and paralyze the Court’s decision-making process.

Hasani said the reason Osmani cited is a great embarrassment and an indelible stain on the office of the President of Kosovo.

“This withdrawal is evil to its core and aims to block and paralyze decision-making in the Constitutional Court regarding the decision expected to be made by August 8, when the temporary measure issued by the Court expires. As an action, it is completely contrary to the Constitution of Kosovo and represents a flagrant violation of it. The President of Kosovo should not dare to make such statements at a time when the Constitutional Court is expected to rule on other, much more important issues,” said Hasani.

He added that her request was fictitious and clearly unfounded.

“She is a lawyer and knows this well. But she submitted the request with the intent to attack the Constitutional Court, knowing that this institution has only seven judges — just enough for a quorum — and that removing one of them would paralyze and block the Court from making any decisions. The action, as such, is entirely fictitious and aimed at attacking the Court to cripple its functioning. Mr. Radomir Laban has been there for seven years, if I’m not mistaken, and she has had this information about him since the first day of her term as President of Kosovo,” he emphasized.

Hasani pointed out that the Constitutional Court, under the Constitution and the Law on the Constitutional Court, has self-immunizing mechanisms and instruments to overcome fictitious and diabolical situations like the one created by Osmani.

“I want to believe that the Court will not succumb to this blackmail and that it will continue its work and make decisions in accordance with the Constitution and the law,” Hasani concluded.
