The intention of Pristina to revoke the certificate of Mts is a gross violation of all laws

After the last information appeared in the public that Pristina intends to cancel the certificate of the company Mts D.O.O. absolutely illegally and despite all procedures, Kosovo Online dealt with this topic in detail in order to inform the public about completely accurate and correct facts that can be very easily and simply checked.

We checked with the authorities in the company Mts D.O.O., which as a daughter company of Telekom Srbija, conducts its business absolutely and completely in accordance with the regulations of Pristina and asked them to comment on these allegations. Namely, extracts from the register for Mts D.O.O. in no document do they state "Kosovska Mitrovica, Republic of Serbia", in fact nowhere does it say "Republic of Serbia".

Moreover, the company was completely legitimately established in accordance with the ratified Brussels Agreement by Pristina, according to local regulations and using documents issued by Pristina (all of which can be seen from the register extracts). The complete documentation is fully in accordance with the regulations of Pristina, as well as all personal documents of legal representatives.

The only questionable document is the alleged existence of a Serbian passport in the registry archive, which allegedly says Kosovska Mitrovica, Republic of Serbia. Allegedly, because the deletion decision only states that:

"The Ministry of Industry, Entrepreneurship and Trade with its decision No. 4009/02 from 06.07.2023 established the Commission for the re-verification of the case files of the Kosovo Business Registration Agency (KBRA).

Based on the Commission’s report no. 4427/02 from 21.07.2023, it seems that in the files of the case Mts D.O.O. registratio no. 81164029, there is a document/passport no.008526874 issued by the Republic of Serbia to Zoran Milojevic (legal representative), wherein the section 'place of birth' says 'Kosovska Mitrovica, Republic of Serbia'."

This information about the passport does not appear in any official extract or another identification document of the register of Mts D.O.O., but only Zoran Milojevic's identity card issued by Pristina is attached and shown everywhere. Since the submission of the documentation to the registry, from the establishment onwards, there is no information in the archive that Zoran Milojevic's passport was ever used.

Moreover, according to information from Zoran Milojevic, he was never issued a passport under the serial number 008526874, neither valid nor expired. Even if a copy of a passport was ever submitted (and as far as is known, it does not exist), from all the documents, including the decision itself, it is not at all clear why that passport would be legally relevant, when it is not used for any registration document.

On top of that, even if any of that is relevant, and it is not, it is unclear how "place of birth" can offend the Constitution and public order of Kosovo when at the time when Zoran Milojevic was born in 1968, it was the Republic of Serbia, just like almost all citizens from the former Yugoslavia, the documents show SFRY as the place of birth.

If it is about the place of current residence, as 'current' information, then there is room for discussion, but that is not the case here. Apart from the decision in question, there is no access to the above-mentioned report of the Ministry of Industry Entrepreneurship and Trade Commission no. 4427/02, nor the alleged documents themselves, which were used as alleged evidence.

A separate topic is that, given all the above, it is completely unclear how the place of birth, which is a historical fact, can have any legal consequences, even in terms of deleting the legal representative, let alone liquidating the entire company.

The deletion decision states that the name used for his place of birth and country is a violation of alleged constitutional norms and also allegedly poses a serious threat to public safety. That is why a request was submitted to obtain information of public importance in order to obtain a copy of the alleged passport.

Kosovo Online has come into possession of official documents that prove the above-mentioned claims.
