Stano: The inclusion of the Venice Commission is not foreseen in the agreements, Kosovo must fulfill its obligations from 2013 and 2015.
The spokesperson of the European Union, Peter Stano, stated that the inclusion of the Venice Commission was not foreseen in the 2013 and 2015 agreements on the establishment of the Community of Serb Municipalities, and that Pristina should stop delaying its obligations regarding its formation, reports Gazeta Express.
"It is up to Kosovo, as a member of the Venice Commission, to seek legal advice on draft laws or laws already in force, including the European proposal for a draft Community statute." We expect that Kosovo will react quickly on this issue and that it will stop delaying the fulfillment of its obligations", said Stano.
He added that Kosovo must take the next steps in accordance with the 2013 and 2015 agreements.
"The European proposal for the draft statute was written by a team of the EU special envoy together with renowned international legal experts, as well as experts from France, Germany, Italy and the USA, since the parties were not able to involve themselves in the drafting process. After the presentation of the European draft statute proposal to Prime Minister Albin Kurti and Serbian President Aleksandar Vucic in October 2023, Kosovo must take the next steps in accordance with the agreements from 2013 and 2015, as stated above," the EU spokesperson emphasized.
He added that the Quint countries and the EU have clearly stated their position and expectation for the next step that Kosovo should take in the process of implementing the agreements from 2013 and 2015 in the formation of the Community of Serb Municipalities.
"The EU and Quint have very clearly stated their position and expectations regarding the next step that Kosovo should take in the process of implementing the two Brussels agreements (2013 and 2015) regarding the establishment of the Union of Municipalities with a Serbian majority. that is, referring the Draft European Statute to the Constitutional Court for constitutionality assessment and for the Constitutional Court to declare the request acceptable," added Stano.
The response of the EU spokesperson came just a few days after the Kosovo Prime Minister stated that Miroslav Lajcak, the EU's special mediator in the dialogue between Belgrade and Pristina, should submit the draft of the CSM to the Venice Commission himself, and that he, as prime minister, would submit the draft to the Constitutional Court.
