Uglanin: We rejected the request for a referendum on the land near the Vojni remont site because such a law does not exist

President of the Assembly of the Municipality of North Mitrovica, Nexhat Uglanin, says that the law for a referendum on revoking the decision regarding the allocation of land near the Vojni remont site, submitted by the Serbian Democracy, has been rejected because such a law does not exist.

"Regarding the petition submitted by the Serbian Democracy as a political entity that gathered 2,213 signatories, we accepted it in accordance with the law, Article 71. Prior to that, I warned the President of this political entity, Aleksandar Arsenijevic, that there would be no legal basis for their claim based on the article, as the article refers to a referendum, given that there is no referendum law, and they relied on that," Uglanin told Kosovo Online.

He added that in accordance with the Law on Local Self-Government, they had taken the petition for consideration and confirmation of the decision.

"We are obliged to reject the petition because it is not within the scope of the law, and that is what we decided. We responded to the political entity on February 23 and then submitted it to the Ministry of Local Self-Government, and we acted in accordance with the law. Since it is widely known, as I mentioned, that there is no Referendum Law, and they relied on it, that request and petition were rejected by the Assembly of the Municipality of North Mitrovica," Uglanin stated.

The members of the Assembly of the Municipality of North Mitrovica adopted a decision on December 29 to allocate land to the Kosovo Ministry of Internal Affairs near the Vojni remont site, covering an area of 27,400 square meters. Serbian Democracy submitted a petition with 2,213 signatures on January 25 for the revocation of the decision of the Assembly of the Municipality of North Mitrovica regarding the allocation of this plot.

In the response from the chairperson of the Assembly of North Mitrovica, which Kosovo Online had access to, it is stated that at this time, a local or any referendum cannot be held.

"Due to the fact that there is no Referendum Law in Kosovo (based on which procedural principles and rules, procedures for initiating referendums - the type of referendum, holding referendums, verification, etc., would exist), a local or any referendum cannot be held at this time. Therefore, the Assembly of the Municipality of North Mitrovica cannot and is not obliged to convene a referendum on the issue within its jurisdiction at the request of citizens," the document states.
