Hearing in case against Ibar-Lepenac; Lawyer: Jaksic proved Jezero Motel was demolished illegally

The second hearing in the lawsuit filed by the Jaksic family from Zubin Potok against the Ibar-Lepenac company was held today before the Basic Court in South Mitrovica. Jordan Jaksic, the owner of the demolished Jezero Motel, and Ibar-Lepenac Director Faruk Mujka testified at the hearing.

Vasilije Arsic, attorney for the Jaksic family, confirmed to Kosovo Online that his client had presented evidence today concerning the alleged unlawful demolition.

“Jaksic proved that the property he owned was demolished illegally. The documentary evidence we submitted as the plaintiff proves the undisputed fact that the entire process of demolishing structures at Lake Gazivode was illegal and carried out in violation of all applicable laws,” Arsic said.

He expressed hope that the court would objectively assess the documentary evidence presented during the proceedings.

Arsic also said that the lawsuit had meanwhile been expanded to include the Kosovo Police and the Ministry of Environment, Spatial Planning and Infrastructure.

“They participated in the demolition of the property. We are awaiting their response, after which the court will make a decision accordingly,” Arsic said.

The first hearing in the proceedings against Ibar-Lepenac was held on August 12.

The Jaksic family filed the lawsuit together with a motion for an interim measure that would prevent any potential demolition of structures or alteration of the existing situation on the ground until the court proceedings are concluded.

Despite the motion, the motel was demolished on July 30 on the company’s orders.

More than 30 structures at Lake Gazivode have been demolished to date.
