Baraliu: Kurti is clear on the CSM, LDK would not share responsibility on the matter
Constitutional law professor Mazllum Baraliu said that a potential agreement between Self-Determination and the Democratic League of Kosovo (LDK) would not automatically mean that responsibility for establishing the Community of Serb Municipalities (CSM) would be shared, because Albin Kurti's position on the matter is clear.
Baraliu explains that, in a potential coalition government, LDK's participation in any arrangement would be “asymmetrical”, meaning that the party could receive three ministries and the position of deputy prime minister, as it has reportedly been offered, or at most four or five portfolios.
“But that is not the point. The government has 19 or 20 ministries. I think that, in this respect, Kurti is clear and vocal. He has said that he will not implement any Community, although at times he says he will implement something else that has been agreed. That remains to be seen, as it is not known,” Baraliu told Kosovo Online.
Baraliu believes that LDK is seeking a greater share of government than its electoral result would warrant, adding that the distribution of responsibility should be a matter for the two sides to agree on.
“I think that is the only option, for the election winner and LDK to find a solution, whether through a comprehensive political agreement or through joint participation in the government, in accordance with the percentages won in the elections. And within that, there should also be an arrangement for a consensual, rather than a party-affiliated one. If that does not happen, Self-Determination can give up that position and leave it to the Democratic League of Kosovo. So, there are choices and ways, methods, models... It only depends on goodwill. Unfortunately, we do not see that at the moment, and the parties should address this, since the only alternative left is an agreement between Self-Determination and LDK,” Baraliu said.
