Bugaqku: It is clarified that a majority of MPs from the Serbian community must nominate the deputy speaker

Vullnet Bugaqku of the Kosovo Democratic Institute assessed that the decision of the Kosovo Constitutional Court regarding the election of Nenad Rasic as Deputy Speaker of the Kosovo Assembly was predictable, and that the Court unequivocally clarified that the candidate for Deputy Speaker from the Serbian community must be nominated by a majority of MPs representing that community.

Speaking to Kosovo Online, Bugaqku said that the Constitutional Court emphasized that the procedure that led to the election of Nenad Rasic as Deputy Speaker was accompanied by clear violations of constitutional principles, both from a procedural and a substantive standpoint.

“In essence, the Constitutional Court unequivocally clarified that the candidate for Deputy Speaker from the Serbian community must be nominated by a majority of MPs representing that community. This constitutes a prerequisite for the validity of the nomination and, consequently, for the proper constitution of the Assembly itself,” Bugaqku said.

He explained that Rasic therefore did not meet the constitutionally prescribed criteria for election to this position, as he was not nominated in the manner and through the procedure required by constitutional provisions and confirmed by the latest decision of the Constitutional Court.

In response to an appeal by the Serb List, the Kosovo Constitutional Court found that the procedure for the election of Nenad Rasic as Deputy Speaker of the Kosovo Assembly was not in accordance with the Constitution.

The decision states that the decision on Rasic’s election was not in line with paragraph 4 of Article 67 of the Constitution of Kosovo.
