German Embassy: Personal attacks against judges are unacceptable, they undermine trust in the Constitutional Court

The German Embassy in Pristina emphasized in a response to Kosovo Online that attacks on judges are unacceptable and undermine trust in the Constitutional Court and its independence. As they stressed, allegations against democratically appointed judges must be presented clearly and properly in accordance with the relevant legal procedures.

Regarding the accusations made by Kosovo authorities against Constitutional Court judge Radomir Laban, as well as the court’s decision on the constitution of the assembly, the German Embassy underlined that it is vital for the Constitutional Court to be able to independently carry out its mandate.

“As a key democratic institution in an independent country, it is vital that the Constitutional Court of Kosovo is able to independently carry out its mandate. Personal attacks against judges – just because a judgment is not liked – are unacceptable and undermine the trust in and independence of the Court. Allegations against democratically appointed judges must be brought forward in a clear and orderly way in accordance with the appropriate legal procedures,” the German Embassy stated.

They added that the embassy is watching with concern politically motivated allegations that hinder the effective functioning of the Constitutional Court.

“We fully support the Constitutional Court and view with concern politically motivated allegations that hinder its effective functioning, especially in a time where the Parliament has not yet managed to fulfill its duties of representing its citizens that have voted over half a year ago,” the German Embassy concluded in its response.
