Jevtic: The Court ruled - Sasa Milosavljevic's rights were violated

The mayor of Strpce, Dalibor Jevtic, announced that the Constitutional Court in Pristina, after the verdict in favor of Jadran Kostic and Sasa Spasic, had made a decision to accept the appeal of Sasa Milosavljevic, another person arrested in the case of "Brezovica", and had ruled that his basic rights had been violated.

Jevtic published a part of the decision of the Constitutional Court on his Facebook profile.

In the explanation of the decision, it is stated that it was unanimously determined that the decision of the Court of Appeals from September 5 last year is not in accordance with the Constitution and the European Convention on Human Rights.

"In other words, Sasa is in custody illegally," Jevtic emphasized.

He highlighted the dissenting opinion of one of the judges, who stated, among other things, that the Court "had to declare null the decision of the Court of Appeals from September 5, 2022, and the decision of the Basic Court from September 13, 2022, that is, all subsequent decisions based on which Milosavljevic was held in unconstitutional custody".

That judge stated that he believed that the Court should have introduced a temporary measure and ordered the regular courts to immediately abolish unconstitutional detention in accordance with the conclusions of the verdict and replace it with a milder measure of ensuring the presence of the defendant in the criminal proceedings.

"There is no need to add anything to this, except to ask the question: Why are our brothers still in custody?” Jevtic asked.
