Ukshini: If Osmani’s decree remains in force, Kosovo will remain only with a caretaker Government after April 4

Former Kosovo ambassador to Albania, Syle Ukshini, says that if the decree of President Vjosa Osmani on dissolving the Assembly remains in force, Kosovo will remain only with a caretaker government after April 4, when her mandate expires.

“That would be a vacuum that Kosovo has never had since the war. If Ms. Osmani leaves and the parliament is dissolved, then the duty will be taken over by Albulena Haxhiu (Speaker of the Assembly), with limited capacity,” Ukshini told Kosovo Online.

He says that the key issue is what the Constitutional Court of Kosovo will decide: whether it will annul the decree of Vjosa Osmani and whether it will give the right to the Self-Determination Movement to continue the process of electing the president of Kosovo.

“If the decree is not accepted, then the Government has a special opportunity to quickly reach a compromise with the Democratic Party of Kosovo and obtain agreement to vote for the president. Many legal experts, as well as the former president of the Constitutional Court Enver Hasani, have said that Kosovo is a parliamentary state and that the power of members of parliament comes from the people. The people elect MPs, and the MPs elect the president. From this perspective, it makes no sense to take the mandate from someone who elected you. For example, if a foreign minister appoints an ambassador, the ambassador cannot appoint the minister. I believe that the Constitutional Court has the possibility to overturn this decree. If that happens, the game starts from the beginning,” Ukshini said.

The Constitutional Court of Kosovo yesterday issued a temporary measure regarding the decree of President Vjosa Osmani on dissolving the Assembly, valid until March 31, which prohibits “any action by the President of Kosovo related to the decree of March 6, as well as any action by the Assembly of Kosovo” until the court’s final decision.
