Vujinovic: Constitutional Court will reach a “middle-ground” solution, parties will accept it

Security studies researcher Nikola Vujinovic said that the Constitutional Court, regarding the requests submitted by PDK for an interpretation of the procedure for constituting the Kosovo Assembly and forming the government, will reach a “middle-ground solution”, which will mean that subsequent decisions cannot be made without the appointment of the fifth deputy speaker of parliament.

The requests submitted by PDK to the Constitutional Court for interpretation concern the constitution of the Kosovo Assembly and the formation of the government, and the court decided to combine the requests into a single proceeding.

According to Vujinovic, there are two reasons for combining them.

“The first is to make the consideration of these proceedings more efficient, because it simplifies the time required, and the second is to provide a final answer to the entire situation. Over the past month and a half, we have seen that each side has its own interpretation of certain provisions,” he told Kosovo Online.

He said that another reason for combining the requests is the Kosovo Constitutional Court's need to provide a final answer, although, Vujinovic added, previous decisions had already been very clear.

He also expects a “middle-ground solution” from the Constitutional Court.

“I would be surprised if the Constitutional Court did not establish that the Constitution had been violated and did not call for a return to the beginning, that is, for the process to start again with the constitution of the Assembly. However, given the previous decisions, we will have a middle-ground solution, namely that everything adopted by that Assembly, including the government, will be considered legitimate, but that for subsequent decisions, including the election of the president, the fifth deputy speaker must be elected,” he said.

According to Vujinovic, this is where the internal political crisis comes in, but all parties will accept the court's decision.

“But the next time the same issue is raised, we will again have different interpretations, because it seems to me that politicization and, in a way, the abuse of politics are characteristic of Albanian political parties, and that in this way they want to discredit even their own legal system,” Vujinovic said.
