Zulfaj: CSM Draft will not be sent to Constitutional Court, it is not binding for Kosovo
Advisor to the Kosovo Prime Minister, Jeton Zulfaj, stated that the Draft statute of the Community of Serb Municipalities, prepared by the European Union, is not binding for Kosovo. In an interview with Kosova Press, he said this document, which is described as a "non-paper," will not be submitted to the Constitutional Court, despite pressure from the EU and Kosovo's partner countries.
“It cannot be sent because it was not accepted; it was rejected on October 26 last year. That time has passed. It was an offer for signing, and Serbia rejected it,” Zulfaj said.
Despite what European and American officials say, he referred to the document as a “non-paper.”
“It was not signed. How else can we describe such a draft?” he asked.
As he added, the draft would have been binding had Serbia agreed to sign the Brussels Agreement and the annex from Ohrid.
“On October 26 last year, the Prime Minister offered to sign the agreement to make the proposed draft an obligation that would then be returned to Kosovo. However, Serbia refused to sign it. The Prime Minister’s stance was that without a signature, there is no acceptance; thus, when Serbia declined to sign, it did not accept it. Consequently, the draft is not accepted,” Zulfaj explained.
He accused Serbia of being destructive in the dialogue process and of failing to implement agreements. He also expects the EU to take a new approach to the normalization process, even though no high-level meetings are scheduled in Brussels.
On the other hand, Zulfaj sees the dialogue as an obstacle to the disbursement of millions of euros for Kosovo as part of the EU Growth Plan for the Western Balkans.
The Prime Minister's advisor also discussed the European Commission’s report, which mentions the progress Kosovo has achieved.
Regarding the unblocking of decision-making in CEFTA, he says this will enable the establishment of a common regional market.
Speaking about the decision to lift the visa regime for Bosnia and Herzegovina, Zulfaj stated that they expect Sarajevo to officially implement the agreement on freedom of movement.
