Miljkovic: The only solution is for the court to acquit Jelena Djukanovic

Attorney Predrag Miljkovic stated today that the trial of Jelena Djukanovic, charged with espionage, has been the fastest in the history of the Special Court in Pristina, noting that the prosecution has failed to prove that she committed the criminal offense she is accused of, and that the only solution is for her to be acquitted.

Following the closing arguments, Miljkovic said that there were no witnesses in the proceedings, and that only the prosecution’s material evidence had been presented.

“These pieces of evidence, in themselves, although numerous, do not provide any substantive level of suspicion, and I believe that the prosecution has failed to prove that Jelena Djukanovic committed the criminal offense she is charged with. This is a collection of evidence that is being speculated upon and interpreted in a manner that suits the indictment. As we heard the prosecutor say today, when he says ‘up there’ he means Serbia, when he says ‘R’ he refers to someone named Ratko, and when he says ‘L’ he refers to another individual…,” Miljkovic stated.

He emphasized that evidence in court must not and cannot be interpreted in such a manner.

“Evidence that is firm and clear speaks for itself, without the need for us to explain it further. In that sense, I believe that the only solution and the only task of the court here is to assess—alongside the fact that there was an unlawful search and analysis of the phone, as well as all the objections we have raised—that the only solution is to acquit Jelena Djukanovic of the charges brought against her,” Miljkovic concluded.

During the closing arguments, Special Prosecutor Bekim Kodraliju stated that it had been established during the trial that the accused had committed the criminal offense she is charged with, and requested the maximum sentence.

The verdict in this case will be delivered on April 27.

Djukanovic was arrested on February 28 of last year on suspicion of the criminal offense of espionage, following a months-long investigation.

On September 2, 2025, the Special Prosecution of Kosovo filed an indictment against Djukanovic, alleging that from an unspecified date until her arrest on February 28, 2025, in her capacity as a local OSCE official in Kosovo, at the Regional Office in Mitrovica, she “with full awareness and direct intent committed multiple acts constituting active assistance to an intelligence service—the Security Information Agency (BIA) of the Republic of Serbia.”

She is accused of providing “data, documents, and sensitive information obtained in the course of performing her official duties within the OSCE, through numerous communications with Aleksandar Vlajic, now convicted of espionage and a resident agent of the BIA.”

Djukanovic pleaded not guilty before the court.
