Self-Determination Movement requests annulment of the CEC decision to certify Serb List for election participation

The Self-Determination Movement has filed a complaint with the Election Complaints and Appeals Panel (ECAP) against the decision of the Central Election Commission (CEC) to certify the Serb List for participation in parliamentary elections, demanding that the decision be annulled.

In a statement, Self-Determination claims that the CEC, "in an unprecedented manner" and contrary to the Law on General Elections, recently allowed the Serb List to participate in the elections.

“Making a decision in the name of the CEC, but without the CEC's approval, represents a new attack on our legal order in favor of the Serb List. Every CEC decision must be subject to a vote by its members. This is not a CEC decision because it was not voted on. It is illegal, as it contradicts the Law on General Elections. Until the Serb List is approved in accordance with the law, this is unlawful,” the Self-Determination statement said.

The statement also alleges that the Serb List “has been and remains the party of the main terrorist, Radoicic,” adding that Radoicic “previously used it against Kosovo and now uses it as a structure to protect and amnesty terrorism.”

“Independent national institutions, such as the CEC, must not only uphold values like legal and constitutional order but also preserve their institutional integrity. Allowing a structure that opposes Kosovo and protects terrorists to secure a place on the ballot by blatantly violating the Election Law and established practices cannot be permitted. Therefore, the goal of Self-Determination's complaint is to annul the illegal decision, protect the legal order, and prevent the approval of the Serb List,” the statement added.

The Central Election Commission announced on December 31 that the decision by the Election Complaints and Appeals Panel to allow the Serb List to participate in the elections on February 9 must be implemented.

The certification of the Serb List's candidacy was also mandated to the CEC by the Kosovo Supreme Court, which dismissed Self-Determination's appeal.
