EU: Decision to dismiss Serbian prosecutors appears incompatible with the law and the rule of law

The European Union has expressed concern over the decision to dismiss Serbian prosecutors, stating that the move appears incompatible with the rule of law.

According to the statement issued in Brussels, Kosovo is, under its Constitution, a multiethnic society founded on the rule of law, and its judicial system must reflect Kosovo's ethnic diversity.

The EU recalled that it has consistently called on Kosovo to facilitate the reintegration of Serbian judicial personnel in accordance with Kosovo's legislation and the agreements reached within the EU-facilitated Dialogue.

"We welcomed the decision of 15 July 2026 to withdraw the resignations submitted by Serbian judges, prosecutors, and judicial administrative staff," the statement said.

At the same time, the EU expressed concern over yesterday's decision by the Kosovo Prosecutorial Council to accept resignations that had already been withdrawn, as well as today's decision by the Acting President of Kosovo to formally confirm those resignations by decree.

"This appears to be incompatible with the law, the principles of due process, and the overall requirements of the rule of law in Kosovo. The European Union calls on all competent institutions to refrain from actions aimed at preventing the reintegration of Serbian judicial personnel," the statement concluded.

Earlier today, Acting President of Kosovo Albulena Haxhiu announced that she had signed decrees dismissing seven prosecutors from the Serbian community who had submitted their resignations in 2022.
