Krieziu: Kosovo Parliament acted unconstitutionally and outside the Rules of Procedure

Former Constitutional Court judge Kadri Krieziu stated today that the actions undertaken yesterday by the Kosovo parliament were not based on the Constitution and that Kosovo President Vjosa Osmani must call extraordinary parliamentary elections in consultation with all parties, including the Serb List.

“The actions undertaken yesterday by the Kosovo parliament were not based on the Constitution, because the election of the president required the presence of two-thirds of MPs to meet the quorum, that is, 80 MPs. Therefore, the actions were unconstitutional and contrary to the parliament’s rules of procedure,” Krieziu told Kosovo Online.

He stressed that the President of Kosovo must now call early elections and invite all political entities, including the Serb List, to consultations in order to determine a new election date.

“Once the election date is determined, a period of 45 days must pass. This is an extraordinary situation and it should not be handled in this manner. Procedures based on the Assembly’s rules must be followed. The actions they undertook were outside the rules of the Assembly. This implies that they do not know how to deal with cases before the Constitutional Court and that they are taking such steps without consulting legal experts,” Krieziu said.

President Vjosa Osmani scheduled consultations with the leaders of political parties at 1 p.m. to agree on the date of new elections, after announcing this morning the decision to dissolve the Assembly of Kosovo due to the failure to elect a president.

Speaker of the Assembly of Kosovo Albulena Haxhiu announced last night that she had addressed the Constitutional Court regarding the assessment of the constitutionality of the procedure for electing the President of Kosovo.
