Bajraktari: No Assembly without the election of all deputy speakers, that is also the 2014 Constitutional Court ruling
Lawyer Ardijan Bajraktari told Kosovo Online that the 2014 Constitutional Court decision clearly stipulates that the Assembly can only be constituted with the election of all deputy speakers, and that “any other interpretation is contrary” to that standard.
The ruling Self-Determination Movement claims that the process of constituting the Assembly of Kosovo has been completed and that the next phase should begin—the formation of a new government. This was also the reason for yesterday’s meeting between Kosovo President Vjosa Osmani and the newly elected Speaker of Parliament, Dimal Basha.
After that meeting, her office announced that “the Presidency’s legal team is conducting an analysis regarding the process of constituting the Assembly of Kosovo.”
Bajraktari was unequivocal about the conditions under which the process of constituting the parliament is concluded.
“The Assembly of Republic of Kosovo is constituted by electing the Speaker and the Deputy Speakers, who form the Presidency of the Assembly and are responsible for its administrative work. Without electing the members of the Presidency, the Assembly cannot be considered constituted,” Bajraktari emphasized.
He explained that the Constitutional Court had already ruled on this 11 years ago.
“This was decided by the Constitutional Court of Republic of Kosovo back in 2014, and this decision was subsequently reaffirmed by two of the most recent rulings, one in June and one in August. Any other interpretation or procedure is contrary to this standard, which was established by the Constitutional Court and which remains valid and in force,” Bajraktari stressed.
