ECAP accepts the Serb List’s appeal against the CEC decision, orders publication of results

The Electoral Complaints and Appeals Panel (ECAP) has upheld the appeal filed by the Serbian List against the decision of the Central Election Commission (CEC) not to publish the final election results for this political entity and its candidates. The Panel ordered the CEC to publish the final results for this political entity and its candidates in the snap elections for the Assembly of Kosovo held on 28 December 2025, Reporteri reported.

“The Panel, after reviewing the case file and the reasoning of the CEC contained in the appellate decision of 31 January 2026, under protocol number 01/156/2026, finds that such a position cannot be accepted as fair and lawful, as it is contrary to the legal provisions of the Law on General Elections,” the decision states, as reported by Koha.

The Panel emphasized that it does not agree with the decision of the Central Election Commission not to publish the final results of the snap elections for the Assembly of Kosovo held on 28 December 2025 for the political entity Serb List and its candidates.

It was assessed that this decision is unjustified and in complete contradiction with the aforementioned legal provisions.

The Appeals Panel stressed that the CEC provided no legal justification for refusing to publish the results for the Serb List, describing the decision as deficient.

It was also assessed that any partial publication of final results has no legal basis and runs counter to the principles of equality of electoral subjects, legal certainty, and transparency of the electoral process.

The CEC’s decision, it was noted, is contrary to good electoral practices and the standards of the Venice Commission.

An appeal against this decision may be filed with the Supreme Court of Kosovo within 48 hours from the receipt of the decision.

On 31 January, the CEC approved the results of the snap parliamentary elections held on 28 December for all political entities that participated in the elections except for the Serb List.

Three CEC members voted in favor of confirming the results for this party, two from the Self-Determination Movement voted against, while the remaining members abstained.
