Burjani: The CEC’s decision on the Serb List is unlawful and should never have happened

Law professor Blerim Burjani assessed that the Central Election Commission’s decision not to approve the publication of election results for the Serb List is unlawful, recalling that the CEC is not a political body but an administrative electoral authority.

Speaking to Kosovo Online, Burjani emphasized that the CEC should not have acted unlawfully.

“The CEC itself knows that this is not a professional decision based on the Constitution and the law. I believe that the Election Complaints and Appeals Panel will correct this decision of the administrative body and that the CEC will have to implement that decision,” he said.

Burjani stressed that the Central Election Commission is also aware that the law and the Constitution must be respected.

“The CEC knows that it cannot block this list in a political manner. The CEC must respect the law and the Constitution of the state of Kosovo. In this way, time is being wasted for no reason,” Burjani stated.

The Serb List today filed an appeal with the Election Complaints and Appeals Panel against the decision of the Central Election Commission not to publish the final results of the parliamentary elections held on 28 December for that party.

“On behalf of the Serb List, an appeal has just been filed with the Election Complaints and Appeals Panel against the unlawful, anti-Serb, and discriminatory decision of the Central Election Commission, which refused to publish the final results of the extraordinary parliamentary elections for our party, thereby denying 42,759 votes cast by Serbs,” the statement said.
