Kosovo Assembly adopts Resolution on The Hague

The Assembly of Kosovo has adopted a resolution calling on the Kosovo Specialist Chambers and the Specialist Prosecutor’s Office in The Hague to conduct a fair trial of former leaders of the Kosovo Liberation Army (KLA). The Serb List left the chamber prior to the vote, while the Democratic League of Kosovo (LDK/DSK) also abstained from participating after its request to include a provision on the investigation of post-war killings was rejected.

Composition of Parliamentary Committees Approved
The Assembly approved the composition of 16 parliamentary committees.

One hundred MPs voted in favor, with one vote against.

Of the 16 committees, nine will be chaired by members of the Self-Determination Movement, three by the Democratic Party of Kosovo (PDK/DPK), two by the Democratic League (LDK/DSK), one by Serb list and one by representatives of other communities.
 
Budget Extension for March Adopted

With 99 votes in favor, the Assembly approved the extension of the budget for March.

Due to the failure to adopt the 2026 Budget, the state had already operated for two months under a budget extension law. Pending adoption of the Budget Law in two readings, the Government requested a further extension to avoid disruptions in the payment process.

The Serb List once again did not participate in the vote.
 
Resolution Adopted; Serb List and LDK Leave Chamber

Ninety MPs voted in favor of the resolution, one voted against, and there were no abstentions.

The Serb List left the chamber before the vote on the Resolution on The Hague.

The LDK did not participate in the vote because its proposal to include a clause addressing the investigation of post-war killings was not incorporated into the text.
 
LDK Proposal to Include Post-War Killings

Following the reading of the draft, LDK parliamentary group leader Jehona Ljušaku stated that there had been agreement only to place the item on the agenda, not agreement on its content.

She requested the addition of the following provision:

“This resolution calls upon all law enforcement institutions of the Republic of Kosovo and encourages international support to intensify efforts toward the full clarification of all unresolved cases that occurred during and after the war period in Kosovo, in order to ensure justice for all victims, uncover the truth, and strengthen the rule of law based on the principles of impartiality and equality before the law.”
Perparim Gruda subsequently stated that no changes would be made to the text.
 
Resolution Presented by Perparim Gruda

PDK MP Perparim Gruda presented the resolution to the Assembly, calling for adherence to law and international standards by the Kosovo Specialist Chambers and the Specialist Prosecutor’s Office.

Full Text of the Resolution:

Calls upon the Kosovo Specialist Chambers and the Specialist Prosecutor’s Office, in the performance of their functions, to ensure strict compliance with constitutional and international standards relating to fair and impartial judicial proceedings, in accordance with the principles of transparency, accountability, and strengthening public trust in the judiciary.

Calls upon the Specialist Chambers and the Specialist Prosecutor’s Office to guarantee the application of standards protecting the fundamental rights and freedoms of the accused, including obligations arising from the jurisprudence of the European Court of Human Rights.

Calls upon the Ombudsperson of the Specialist Chambers—whose exclusive accountability toward the Specialist Chambers and the Specialist Prosecutor’s Office derives from the Constitution of the Republic of Kosovo—to act with full independence and impartiality in accordance with constitutional obligations and international standards applicable to this function.

Encourages all democratic states, including those financing and supporting the Specialist Chambers and the Specialist Prosecutor’s Office, to join this call for full adherence to international standards of fair and impartial judicial proceedings, as derived from the constitutional traditions of democratic states and from acts and recommendations of international mechanisms, including but not limited to the United Nations, the European Union, the Council of Europe, and the Organization for Security and Co-operation in Europe (OSCE).

Encourages oversight mechanisms within international organizations, as well as international and domestic non-governmental organizations, to intensify monitoring of the compliance of the Specialist Chambers and the Specialist Prosecutor’s Office with international standards for the protection of fundamental rights and freedoms in judicial proceedings and to report any identified violations.

Reaffirms commitment to ensuring all mechanisms, including financial support, to safeguard the defense rights of leaders and members of the Kosovo Liberation Army before the Specialist Prosecutor’s Office and the Specialist Chambers.
Reaffirms full commitment to taking all necessary steps to affirm the values of the struggle of the Kosovo Liberation Army and the sanctity of the history upon which the Republic of Kosovo was built.
 
Resolution on The Hague Moved to First Item on the Agenda

Head of the AAK parliamentary group, Besnik Tahiri, requested that the third agenda item—the Resolution on The Hague—be moved to the first position.

“I request that the third item, the Resolution on The Hague, be placed first, as President Ramush Haradinaj has an obligation and wishes to participate in the vote,” Tahiri said.

The proposal was approved by Speaker Albulena Haxhiu after a vote on amending the agenda. All 101 MPs present voted in favor.
 
Session Began with One-Hour Delay

The extraordinary session of the Kosovo Assembly, originally scheduled to begin at 19:00, commenced nearly an hour late.
Speaker Haxhiu first informed MPs that President Vjosa Osmani had undertaken the necessary legal steps to replace MPs serving in the government who are assuming ministerial duties. Eighteen new MPs subsequently took the oath of office, along with two others who had not done so the previous day.
