Lawyer Delevic requests that the work of the prosecutor, who reclassified the wounding of Serbian children as causing general danger, be re-examined
Lawyer Milos Delevic, who represents two young men from Gotovusa who were wounded by Azem Kurtaj, a member of the KSF, on Christmas Day, asked the chief prosecutor of the prosecution in Urosevac to review the work of prosecutor Fatos Ajvazi, who had reclassified this act as causing general danger and using firearms.
Delevic told Kosovo Online that the prosecutor had made a big mistake when filing the indictment in this case.
"I submitted a request to the chief prosecutor in Urosevac to evaluate the work of the prosecutor in this case in order to possibly change the qualification of this part. The qualification of this part is the mildest form of qualification for what the defendant did, literally as if he shot into the air, and not at the bodies of the boys who were carrying the Christmas tree," Delevic says.
He notes that he will fight with all legal means in order to change the previous qualification into attempted murder.
"The prosecutor's office qualified this act as causing general danger, and that paragraph 1, It is not even paragraph 4 (which causes serious bodily injury). According to the practice in Kosovo, this qualification does not result in an effective prison sentence, but the court goes for probation or a fine. We will ask the prosecution to qualify this case as aggravated attempted murder, which is the practice in some earlier cases," Delevic told us.
