Gashi: The Constitutional Court seems to have become a political party

While awaiting a new decision from the Constitutional Court, which by a temporary measure until September 30 banned MPs from undertaking any activities or initiating procedures to form a new Government of Kosovo, lawyer Tome Gashi told Kosovo Online that this court “seems to have become some kind of political party.”

He said that three rulings of the Constitutional Court “have in effect disabled the institutions of Kosovo” after the February 9 elections, and that now everyone is waiting to see what it will decide regarding the Serb List.

“I don’t think the Court has to accept that only the Serb List represents the Serbian people living in Kosovo. Every Serbian political party has the right to represent the Serbs, and the Deputy Speaker of the Kosovo Parliament can be anyone who secures the votes, whether Mr. Rasic or someone else who gets 61 votes in parliament. That person must become Deputy Speaker, it does not always have to be someone from the Serb List,” Gashi said.

He also expressed the opinion that “the Serb List should not even exist, since it is closely tied to Milan Radoicic.”

As a reminder, on September 5, the Constitutional Court issued a temporary measure, valid until September 30, which prohibited MPs from carrying out any activities or initiating procedures to form a new Government of Kosovo. The measure was introduced following an appeal by the Serb List regarding the vote for the Deputy Speaker of the Assembly, who must come from the Serbian community.
