Law Institute: Assembly Presidency does not respect the law

The Kosovo Law Institute (KLI) assessed that the refusal of the Assembly Presidency to appoint the Secretary-General of the Assembly, as well as the announcement of a new call for applications without any legal basis, represents one of the most obvious examples of disregard for the law, institutional delay, and arbitrary decision-making by the very body that is supposed to guarantee the rule of law.

In a press release, KLI stated that the Assembly Presidency arbitrarily announced a new call for applications without voting for any of the proposed candidates, which, according to KLI, is in direct contradiction with the applicable legislation, as reported by Ekonomia Online.

“In this case, the failure to select a candidate is not merely a procedural omission. It represents a refusal to apply the law in accordance with the outcome of a lawful administrative procedure. In this way, such conduct constitutes arbitrary interference in a process that had already been completed. Particularly concerning is the fact that the proposal to annul the call did not receive the necessary support within the Presidency. With three votes in favor and three abstentions, the Presidency failed to make any final decision, leaving the Assembly in an unacceptable situation of paralysis of an important institutional body,” the statement said, among other things.

KLI further called on the Assembly to restore legality in this process by selecting one of the proposed candidates and putting an end to arbitrary practices that undermine the integrity of public administration, the normal functioning of the Assembly, and citizens’ trust in institutions.
