Gashi: The Constitutional Court has no deadline for ruling on complaints
Lawyer Tome Gashi told Kosovo Online that the Constitutional Court of Kosovo does not have a legally prescribed deadline by which it must issue a decision or ruling on a submission or complaint. In the case of the appeal filed by the Serb List regarding the election of Nenad Rasic as Deputy Speaker of the Assembly, he believes that the appeal will be rejected.
"I think everything was done in accordance with the law and that the matter is settled. There is no reason for this to be returned for a new vote on the Deputy Speaker of the Assembly. I believe that the Serb List is only seeking or trying to obstruct the normal work of the Assembly for reasons that are already known," Gashi said.
He also believes that the Constitutional Court is aware that there is practically no possibility for the election of either the Speaker or the Deputy Speaker of the Assembly to be returned for another vote.
He does not believe that any problems would arise if a draft law were to be brought before the MPs before the Constitutional Court’s decision is issued, because, as he explains, until a new government is formed, no one can submit a request for the adoption of new laws, since laws are proposed by the government. However, as he points out, "nothing is functioning at the moment."
The appeal to the Constitutional Court concerning the election of Nenad Rasic as Deputy Speaker of the Assembly of Kosovo from the Serb community was submitted on October 16.
