KDI responds to Konjufca: Obstruction of Serb List MPs violates constitutional mandates
The Kosovo Democratic Institute (KDI) stated that preventing Serb List MPs from attending the Kosovo Assembly session constitutes a violation of their constitutional mandate.
“During today’s plenary session, the Speaker of the Assembly and MPs from the parliamentary majority unlawfully prevented the Serb List parliamentary group from participating in the Assembly’s work. Although the Serb List has been boycotting the Assembly since 2022, and their attendance today was solely to retain their mandates, their prevention from participating in the session represents a breach of their constitutional mandate,” the statement read.
KDI also criticized the Serb List for its lack of participation in the Assembly’s work, arguing that this behavior “reduces opportunities for communication between non-majority communities and the government.”
“Moreover, the non-participation of the Serb List has directly impacted legislative procedures, especially those requiring a double majority,” the statement added.
KDI reminded that, under the law, while a boycott as a political tool negatively affects the Assembly’s efficiency, it does not justify preventing MPs from participating in the Assembly’s work.
“According to the Rules of Procedure, MPs can only be removed from a session if they use offensive language, threaten the dignity of the session chairperson or other MPs, or persist in violations for which they have already been sanctioned. A session can only be suspended in cases of chaos in the hall or if MPs disregard the chairperson’s call to maintain order,” KDI concluded.
